Mandatory Drug Testing is Required For All Commercial Truckers by the DOT

The Federal Motor Carrier Safety Administration (FMCSA), along with the Department of Transportation (DOT), requires that persons subject to the commercial driver’s license (CDL) requirements and their employers follow alcohol and drug testing rules. These rules include procedures for testing, frequency of tests, and substances tested for.  Part 382.115 is violated when a motor carrier fails to implement a DOT drug and alcohol-testing program for its drivers. Top settlement was over $5,000, the average settlement is over $2,000.

Who gets tested?

All commercial Driver’s License (CDL) holders who operate Commercial Motor Vehicles, 26,001 lbs. gvwr. or greater, or operate a vehicle that carries 16 passengers or more including the driver, or required to display a DOT placard in the transportation of hazardous material.

When will I be tested?

Safety-sensitive employees are subject to drug or alcohol testing in the following situations:

• Pre-employment. • Reasonable Suspicion/Cause. • Random. • Return-to-duty. • Follow-up. • Post-Accident.

GLR Services & More provides the administration of employees who are subject to drug and alcohol testing.  We complete four (the minimum allowable under DOT regulations) blind computer generated selections per calendar year. Every driver is eligible for every selection. The chances of being selected are dictated by the US DOT and for the current year are 50% for a drug test and 10% for an alcohol test. Our company also provides sample company policies to aid in the development of a standard policy to help your organization inform employees concerning your Drug and Alcohol Abuse/Misuse Prevention Program for both DOT-regulated programs and non-regulated Drug-Free programs.

Remember: Safety-sensitive employees are obligated by law to submit to and cooperate in drug & alcohol testing mandated by DOT regulations.
